These Terms of Use (“Terms”) apply to your use of CreditCardDebt.com and any related content, emails and features (the “site”). By using the site, you agree to these Terms. If you don’t agree, please don’t use the site. Please read these Terms carefully. They include a binding arbitration agreement and a class action and jury trial waiver (see “Dispute resolution” below), as well as disclaimers and limits on our liability.
You must be at least 18 years old, or the age of majority where you live, to use the site.
Educational information, not advice
Everything on this site is general educational information about credit, debt and personal finance. It is not financial, legal, tax, credit or investment advice, and it isn’t tailored to your situation. Reading the site doesn’t create an advisor, attorney or other professional relationship between you and us.
Laws, interest rates, fees, tax rules and product terms change, and they can vary by state and by lender. We don’t guarantee that any article is accurate, complete or current when you read it, and we have no obligation to update it. Before making a decision, check the original sources, read the terms of any product, and consider consulting a qualified professional.
Nothing on the site is an offer to sell, a solicitation, or a recommendation to buy any product, service or security. Any decision you make based on the site is yours alone.
Using the site
You agree not to:
- use the site for any unlawful, fraudulent or harmful purpose
- try to gain unauthorized access to the site, its servers or related systems, or interfere with its operation, for example through hacking, malware or denial-of-service attacks
- scrape, copy or harvest content in bulk through automated means, except for ordinary search-engine indexing
- copy, republish or redistribute our content except as allowed below
- present our content as your own or suggest that we endorse you or your products
Our content and how you may use it
The articles, text, illustrations, design and other content on the site are owned by CreditCardDebt.com or its licensors and protected by copyright and other laws. “CreditCardDebt.com” and our logo are our trademarks.
You may view, print and save pages for your own personal, non-commercial use, and you may share links to our pages. You may quote a short excerpt with a clear credit and a link to the original article. Any other use, including republishing full articles, requires our written permission.
Advertising, partners and compensation
The site may display advertising and sponsored content, and may contain links to and offers from third parties, including financial companies. We may receive compensation when you click a link, submit information, or obtain a product or service from a third party, and this compensation may affect which products appear on the site and where. We don’t review or include every company or offer available. Rates, fees, terms and other details of third-party products are provided by those companies or obtained from public sources, may change at any time, and may not be accurate or current. We don’t guarantee that you will be approved for, or receive the terms shown for, any product. Sponsored content and advertisements may be prepared by or for advertisers and don’t necessarily reflect our views.
Links to other websites
The site links to outside websites and services. We don’t control them and aren’t responsible for their content, products, services, terms or privacy practices, and a link isn’t an endorsement. Any dealings you have with a third party, including applying for or using its products, are solely between you and that third party.
Communications and submissions
If you send us messages, feedback, ideas or other material, you grant us a non-exclusive, worldwide, royalty-free, perpetual and irrevocable license to use, copy, modify, publish and otherwise exploit that material for any purpose, without compensation to you. Don’t send us anything you consider confidential.
Copyright complaints (DMCA)
If you believe content on the site infringes your copyright, send a written notice by email to [email protected] that includes all of the following. Notices that are incomplete may not be acted on.
- your physical or electronic signature, or that of a person authorized to act for the copyright owner
- a description of the copyrighted work you believe has been infringed
- the URL of the material on our site and enough detail for us to find it
- your name, mailing address, telephone number and email address
- a statement that you have a good-faith belief that the use isn’t authorized by the copyright owner, its agent or the law
- a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf
We may remove or disable access to material in our discretion. Knowingly making a false claim of infringement can make you liable for damages. This address is for copyright notices only; other messages may not receive a response.
Disclaimers
The site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We don’t warrant that the site will be uninterrupted, error-free or free of harmful components. You use the site and rely on its content at your own risk.
Limitation of liability
To the fullest extent permitted by law, CreditCardDebt.com and its owners, writers and service providers won’t be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, credit, data or opportunity, arising from your use of, or inability to use, the site or its content, even if we’ve been advised of the possibility of such damages. Our total liability for any claim relating to the site is limited to US $100.
Some jurisdictions don’t allow certain warranty exclusions or liability limits, so some of the above may not apply to you. Nothing in these Terms limits any rights you have that can’t be limited by law.
Indemnity
You agree to defend, indemnify and hold harmless CreditCardDebt.com and its owners, affiliates, employees, contractors, writers and service providers from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or relating to your use of the site, any material you submit, or your violation of these Terms, any law, or the rights of any third party.
Privacy
Our Privacy Policy explains how we handle information. It’s part of these Terms.
Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules.
Dispute resolution, arbitration and class action waiver
Please read this section carefully. It affects your legal rights.
Informal resolution first. Before starting any arbitration or court proceeding, you must first send us a written notice of your claim by email, describing the claim and the relief you seek, and allow 60 days for an informal resolution.
Binding arbitration. If the dispute is not resolved informally, you and we agree that any dispute, claim or controversy arising out of or relating to the site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will take place in Delaware or remotely, as the arbitrator decides. The Federal Arbitration Act governs this section. The arbitrator has exclusive authority to decide all issues about the scope, validity and enforceability of this arbitration agreement, except that a court decides any question about the class action waiver below.
Mass filings. If 25 or more similar claims are submitted by or with the help of the same law firm or coordinated group, the parties agree that they will be administered in batches under the AAA’s mass arbitration procedures, and that statutes of limitation are tolled for claims awaiting their turn.
Class action waiver. You and we agree that claims may be brought only on an individual basis, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate claims or award relief on a class or representative basis. You waive any right to a jury trial.
Time limit. Any claim relating to the site or these Terms must be brought within one year after it arises, or it is permanently barred, to the extent permitted by law.
Court for other matters. If this arbitration agreement does not apply or is found unenforceable, any dispute must be brought exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction. If the class action waiver is found unenforceable, the entire arbitration agreement will not apply.
Changes to the site and these Terms
We may update, change, suspend or discontinue any content, feature or the site itself at any time, without notice, and may restrict or terminate anyone’s access to the site for any reason. We may also update these Terms. When we do, we’ll change the “Last updated” date at the top of this page. Continuing to use the site after a change means you accept the updated Terms.
General
If any part of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision isn’t a waiver of it. We may assign or transfer these Terms without notice; you may not assign them without our written consent. Sections that by their nature should survive, including those on content ownership, submissions, disclaimers, limitation of liability, indemnity and dispute resolution, survive any termination of your access. We aren’t liable for delays or failures caused by events beyond our reasonable control. Section headings are for convenience only. These Terms and our Privacy Policy are the entire agreement between you and us about the site.
Notices
Legal notices to us must be sent in writing by email to [email protected]. We may provide notices to you by posting them on the site.
